|Last Will and Testament of Franz J. Schmidt

|I Franz J. Schmidt of Clinton County State of Iowa being of sound disposing mind and memory and of full age do hereby make and ordain this my last will and testament hereby revoking all former wills by me made.
First- I order and direct my Executrix as soon after my decease as practicable to pay off and discharge all the debts dues and liabilities that my legally exist against me at the time of my decease.
Second- I give and bequeath to my beloved wife Catharine Schmidt all my estate both real and personal in whatever it may consist or wherever situated at my decease to by her used and disposed of during natural life precisely the same as I myself might do if living and giving my wife full power to sell exchange invest and reinvest the same in the same manner I might do if living and to distribute the same by gift or otherwise as shall seem to her best and proper and to appoint the same by will after her decease according to her own judgment and discretion.
Third- But if any of my said Estate shall remain undisposed of by my said wife at the time of her decease I give devise and bequeath all such residue and remainder of my Estate to be divided between my brother John Schmidt’s children and Jurgen Seidensticker and Clauss Hagge and Mary Knapper my wife’s brothers and sisters.
Fourth- I hereby nominate and appoint Catharine Schmidt my wife, executrix of this my last will and testament.

Executed at Wheatland Clinton County Iowa this 25th day of June A. D. 1879.
The foregoing instrument was at the date thereof subscribed by Franz J. Schmidt in our presence and he at the same time declared the same to be his last will and testament. And by his request we signed our names thereto as witnesses both in his presence and in the presence of each other.

I William Kreim, clerk of the District Court in and for said County do hereby certify that on this day at the January Term A. D. 1888 of said Court the will and instrument in writing hereunto annexed and bearing date in the 25th day of June 1879 was duly proved before and allowed by said court as and for the last will and testament of the real and personal estate of Franz J. Schmidt late of said County deceased and was by said Court ordered to be recorded as such will and testament. In witness whereof I have hereunto at my hand and affixed the seal of the court at my office in Clinton in said County this 4th day of February A. D. 1888.
